Federal judge removes Biden-era administrative nursing home staffing rules

A federal judge in Texas abandoned the national mandate of staffing for nursing homes during the Biden era.

On Monday, US District Judge Matthew J. Kaxmalick sided with nursing homes over rules requiring nurses to meet minimum staffing with patient ratios.

“The agency lacks the authority to eliminate consideration of facility nursing 'needs' when prescribing minimum staffing standards,” Kaxmalick wrote, referring to the Centers for Medicare and Medicaid Services.

According to a media release, the plaintiff's American Medical Association (AHCA) represents “about 15,000 nursing homes and long-term care facilities nationwide that provide care to approximately 5 million people each year.”

“This unrealistic staffing mission has threatened to close nursing homes and drive away vulnerable elderly people,” Cliff Porter, president and CEO of the National Center for Living Assistance, said in a statement. “The court's decision not only maintains a balance between the rule of law and authority, but also protects access to care for seniors.”

Porter is now calling on Congress to act, but he says, “federal policymakers should not decide staffing time, but encourage innovation and quality outcomes. Staffing duties are 20th century solutions that Congress should block at once.”

In the United States, “97.8% of nursing homes participate in Medicare and 95.4% participate in Medicaid,” Judge Kakusmalik wrote in the ruling. In other words, it must meet a “integrated set of regulations.”

“As I said from the start, nursing homes want to hire more nurses and caregivers. Despite the limited resources, we do everything to boost our workforce,” Ahca's Porter said in a statement.

“Even before staffing mandate was introduced, AHCA provided federal policymakers with a variety of workforce solutions that would help them build a new caregiver pipeline, attract long-term care, and develop skills and careers,” he said.
