Lawsuit against Cuomo over coronavirus nursing home deaths dismissed

A federal judge has dismissed a wrongful death lawsuit that blamed former New York Gov. Andrew Cuomo for nursing home deaths during the coronavirus pandemic.

The New York Post reports that Judge Rashan Deacy Hall of the Eastern District of New York argued that the father's death was caused by a state health department order requiring nursing homes to accept coronavirus patients in 2020. The court has granted a motion to dismiss a lawsuit filed by a New York man. According to CBS, Norman Arbeney was an 89-year-old Korean War veteran who died in March 2020 at a nursing home in Brooklyn.

Other families who have lost loved ones have also joined the lawsuit, and many more were arrested under the original directive in March 2020 when nursing homes refused to admit patients who were no longer sick enough to require hospitalization. He blamed Cuomo and his administration for the deaths. More than 15,000 people have died in New York nursing homes during the pandemic.

“For the past four years, the debate about COVID-19 in nursing homes has been unrecognizably weaponised, distorted and distorted by those who exploit this situation for their own politics. Whenever the truth prevails, Cuomo press secretary Rich Azzopardi said in a statement. “A judge today ruled to dismiss this case, echoing previous rulings by the Department of Justice and the Manhattan District Attorney, who launched three separate investigations. Once again, justice has prevailed. ”

Arbeeny's son, Daniel Arbeeney, told CBS he plans to appeal.

Cuomo defended his pandemic response during a House committee hearing last month, blaming the Trump administration for a lack of testing and personal protective equipment early in the pandemic. Cuomo also said the committee's report showed no evidence to support the claim that the directive helped spread the virus.

“In fact, the report finds no causal relationship. There were no deaths,” he said.

Cuomo resigned as governor in 2021 after an investigation overseen by state Attorney General Letitia James concluded that he sexually harassed 11 women in the workplace. He also faced scrutiny over a $5 million deal to publish a book about his response to the coronavirus pandemic and an investigation into a nursing home scandal that involved underreporting COVID-19 deaths during the pandemic. .

Mr. Cuomo has not been criminally charged and continues to deny wrongdoing.
